1. Acceptance of Terms
By accessing or using NextTek Voice ("the Service"), operated by NextTek LLC, you agree to be bound by these Terms and Conditions. If you do not agree, you may not use the Service.
2. Description of Service
NextTek Voice is a customer call support platform that enables users to create, configure, and deploy business receptionists for phone calls. The Service includes receptionist setup, telephony integration, call management, appointment support, analytics, and owner handoff.
3. Account Registration
You must sign in using a valid Google account to access the Service. You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use.
4. Acceptable Use
You agree not to use the Service to:
- Make fraudulent, harassing, or illegal phone calls.
- Impersonate any person or entity or misrepresent your affiliation.
- Violate any applicable laws, regulations, or telecommunications rules (including TCPA and similar laws).
- Transmit malicious content, spam, or unsolicited communications.
- Attempt to access systems or data without authorization.
- Use the platform for any activity that could harm NextTek LLC or its users.
5. Pilot Access and Fees
Certain pilot features may require approval or a paid pilot agreement with NextTek LLC. Pilot pricing, included usage, and payment terms are confirmed directly with each customer before service activation.
6. Voice Agent Content
You are solely responsible for your receptionist instructions, greetings, and any communications made through the Service. You must ensure all customer call interactions comply with applicable laws and regulations. We reserve the right to suspend configurations that violate these Terms.
7. Intellectual Property
The Service, including its design, code, and branding, is the property of NextTek LLC. You retain ownership of your content (prompts, configurations, data). By using the Service, you grant us a limited license to process your content solely to provide the Service.
8. Third-Party Services
The Service relies on third-party infrastructure providers, including licensed telephony carriers, AI model providers, and Google services, to deliver calls, transcription, and calendar features. Your use of these integrations is subject to their respective terms of service. We are not responsible for third-party service outages or changes.
9. Limitation of Liability
To the fullest extent permitted by law, NextTek LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
10. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee uninterrupted, error-free, or secure operation of the Service.
11. Termination
We may suspend or terminate your access to the Service at any time for violation of these Terms or for any reason at our discretion. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will remain in effect.
12. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
